What is mediation?
Mediation is a fast, economical and private way to resolve disputes rather than letting them escalate to a more serious, lengthy and expensive matter.
It is a process in which the parties involved, along with a trained, impartial mediator, explore issues and generate options that lead to an agreeable solution for all participants.
Mediation focuses on planning for the future rather than concentrating on the past. Guilt and innocence are not decided. Instead, a feasible solution is developed which meets the needs of all involved parties.
What is a mediator?
A mediator is a trained, neutral party who listens to both sides, asking questions along the way to clarify the issues at hand. Mediators do not take sides or make judgments. The mediator’s goal is to facilitate communication and assist in generating mutually agreeable solutions for all parties involved, rather than letting a court decide the outcome.
What types of disputes can be mediated?
Some examples of disputes which can be mediated are:
- Family disputes: separation, divorce, guardianship, child support, probate, child protective service (CPS).
- General disputes: between neighbors, friends, classmates, or family members; personal injury; debt collection.
- Real estate and property: insurance claims, HOA disputes.
- Business disputes: employer/employee, landlord/ tenant, merchant/consumer.
